These Website Terms and Conditions (“Terms”) govern access to and use of the website located at www.firstlightpestcontrol.com (the “Site”), owned and operated by First Light Pest Control, LLC (“First Light,” “Company,” “we,” “us,” or “our”).
By accessing, browsing, or using this Site, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must not access or use the Site.
These Terms apply solely to use of the Site and any content, functionality, and services offered through the Site. These Terms do not govern pest control services provided by First Light, which are governed exclusively by separate written Service Agreements executed through FieldRoutes prior to service.
All content on this Site is provided for general informational purposes only. Nothing on this Site constitutes a binding offer, service agreement, warranty, or professional advice.
Estimates, pricing, service scopes, warranties, retreatment obligations, exclusions, cancellation policies, and dispute resolution provisions are governed exclusively by separately executed Service Agreements signed prior to the performance of any services.
Submission of a contact form, request for information, email inquiry, or other communication through the Site does not create a service relationship, contractual obligation, or duty to perform services. A binding service relationship is formed only upon execution of a written Service Agreement.
All pest control services are governed solely by the written Service Agreement executed via FieldRoutes. In the event of any conflict between these Terms and a signed Service Agreement, the Service Agreement controls.
All content on the Site, including text, graphics, logos, images, service photographs, marketing materials, layout, design, and software, is the property of First Light Pest Control, LLC or its licensors and is protected by applicable intellectual property laws.
No content may be copied, reproduced, distributed, modified, displayed, or used for commercial purposes without prior written consent.
You agree not to:
• Use the Site for any unlawful purpose;
• Attempt unauthorized access to any portion of the Site;
• Interfere with Site functionality or security;
• Introduce malicious code or harmful technologies;
• Reverse engineer or decompile any portion of the Site;
• Impersonate any individual or entity;
• Use automated means to access, monitor, scrape, or extract data.
Use of the Site for competitive analysis, pricing monitoring, data mining, scraping, harvesting, or copying of marketing materials is strictly prohibited. First Light reserves the right to pursue injunctive relief and all other available remedies without the necessity of posting bond.
The Site and all content are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied. First Light disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and accuracy.
First Light does not guarantee that the Site will be uninterrupted, secure, or error-free.
To the fullest extent permitted by law, First Light Pest Control, LLC shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to use of the Site.
In no event shall First Light’s total liability arising from or related to use of the Site exceed One Hundred Dollars ($100.00).
You agree to defend, indemnify, and hold harmless First Light Pest Control, LLC, its members, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including attorneys’ fees) arising from:
• Your use or misuse of the Site;
• Your violation of these Terms;
• Your infringement of intellectual property rights;
• Any unlawful or unauthorized conduct involving the Site.
The Site may contain links to third-party websites. First Light is not responsible for the content, accuracy, or practices of any third-party sites.
Use of the Site is also governed by our Privacy Policy, incorporated herein by reference.
These Terms are governed by the laws of the State of North Carolina. Any disputes relating to pest control services are governed by the dispute resolution provisions contained in the separately executed Service Agreement.
First Light may assign its rights and obligations under these Terms without restriction. Users may not assign their rights without prior written consent.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Failure to enforce any provision of these Terms shall not constitute a waiver of such provision or any other provision.
These Terms constitute the entire agreement between you and First Light regarding use of the Site and supersede any prior understandings relating to website use.
First Light reserves the right to modify these Terms at any time in its sole discretion. Updated versions will be posted with a revised effective date. Continued use of the Site constitutes acceptance of modified Terms.
